These Terms govern your access to and use of qaliberlearning.com (the "Site") and any services delivered by Qaliber Learning LLC ("Qaliber Learning," "we," "us"). By using the Site or our services, you agree to these Terms.

1. Services

Qaliber Learning provides training-consulting and workforce-development services, including the Diagnostic Sprint and Training Partner engagements. Engagements are governed by a separate written agreement (Statement of Work or Order Form) executed by the parties; in case of conflict, that agreement controls.

2. Pricing

Pricing displayed on the Site is current as of 2026 and is subject to change. Final pricing is established in the applicable Order Form. Engagement-specific per-user pricing and custom course development are quoted per engagement.

3. Cancellation

Training Partner retainers are month-to-month. Either party may cancel an active engagement with the notice period specified in the applicable Order Form (default: 30 days, prior month invoiced in full).

4. Intellectual property

The Qaliber Learning name, the Q monogram, "FORGE Framework™," "QaliberLMS©," all related logos and the contents of the Site are owned by Qaliber Learning. Deliverables produced under an engagement vest as described in the applicable Order Form.

5. Acceptable use

You agree not to misuse the Site, attempt unauthorized access, or use the Site or our services to violate any law or third-party right.

6. Third-party services

The Site links to and integrates with third-party services (e.g., scheduling, fonts, hosting). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third parties.

7. Disclaimers

The Site and any information on it are provided "as is" and "as available," without warranty of any kind. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Information on the Site does not constitute legal, compliance or HR advice.

8. Limitation of liability

To the maximum extent permitted by law, Qaliber Learning is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising out of your use of the Site. Our total liability for any claim arising from the Site (excluding amounts owed under an Order Form) will not exceed one hundred U.S. dollars (USD 100).

9. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws principles. Exclusive jurisdiction and venue lie in the state and federal courts located in Utah.

10. Changes

We may update these Terms periodically. Continued use of the Site after changes are posted constitutes acceptance.
